This website is operated by Free the Sheep LLC.

Throughout the website, the terms “Free the Sheep,” “we,” “us,” and “our” refer to Free the Sheep LLC.

Free the Sheep offers this website, including all information, tools, products, and services available through it, conditioned upon acceptance of these Terms of Service and the policies referenced through the website.

By visiting our website or purchasing from us, you engage in our “Service” and agree to be bound by these Terms of Service, including our:

• Return and Refund Policy;
• Shipping Policy;
• Purchase Options Cancellation Policy; and
• Privacy Policy.

These Terms apply to all users of the Service, including browsers, customers, vendors, merchants, and contributors of content.

Please read these Terms carefully before accessing or using the Service.

If you do not agree to these Terms, you may not access or use the Service.

Any new feature or tool added to the Service will also be subject to these Terms.

We reserve the right to update or replace any part of these Terms by posting changes to the website.

Our store is hosted by Shopify Inc., which provides the e-commerce platform that enables us to offer products and services.


SECTION 1 – ONLINE STORE TERMS

By agreeing to these Terms, you represent that:

• You are at least the age of majority in your state, province, or jurisdiction of residence; or
• You are the age of majority and have authorized any minor dependent using the Service under your supervision.

You may not use our products or Services for an illegal or unauthorized purpose.

You may not violate any applicable law through your use of the Service.

You must not transmit worms, viruses, malware, or other harmful code.

A material breach of these Terms may result in termination or restriction of access to the Services.


SECTION 2 – GENERAL CONDITIONS

To the extent permitted by applicable law, we reserve the right to refuse or discontinue service where reasonably necessary, including in response to:

• Unlawful activity;
• Safety concerns;
• Policy violations;
• Payment disputes;
• Threats to the Service;
• Harassment; or
• Conduct that harms other users.

We will not refuse service for an unlawfully discriminatory reason.

You understand that content other than payment-card information may be transferred across different networks and modified to conform to technical requirements.

Payment-card information is encrypted during transmission over payment networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.

Headings are included for convenience and do not limit these Terms.


SECTION 3 – ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

We make reasonable efforts to keep product, inventory, pricing, shipping, pre-order, and policy information accurate and current.

General educational, editorial, historical, or promotional content may not always reflect the most recent available information and is provided for general reference.

Order-specific information, product representations, promotional terms, and consumer rights remain governed by:

• Information presented at the time of purchase;
• The applicable order confirmation;
• Our posted policies; and
• Applicable law.

We reserve the right to correct errors and update information.

Nothing in this section eliminates any cancellation, refund, delivery, warranty, or other right that cannot legally be waived.


SECTION 4 – MODIFICATIONS TO THE SERVICE AND PRICES

Product prices may change without notice before an order is placed.

We reserve the right to modify or discontinue the Service or any part of it.

We will not be liable for a modification, suspension, or discontinuation except where liability cannot legally be excluded.

Price changes do not retroactively change the price of an order that has already been accepted, except where:

• The order contained an obvious error;
• The customer agrees to the change; or
• Applicable law permits the change.


SECTION 5 – PRODUCTS, SERVICES, PRE-ORDERS, AND RETURNS

Certain products or services may be available exclusively online and may have limited quantities.

We make reasonable efforts to display product colors, images, measurements, materials, features, and descriptions accurately.

The appearance of colors may vary based on:

• Device settings;
• Monitor calibration;
• Screen quality;
• Lighting; and
• Other circumstances outside our control.

We may limit sales by:

• Person;
• Household;
• Geographic region;
• Jurisdiction;
• Sales channel; or
• Order quantity;

where reasonably necessary and permitted by law.

Product descriptions, availability, and pricing may change before an order is placed.

Returns, exchanges, refunds, and non-returnable products are governed by our Return and Refund Policy.

Eligible orders delivered within the United States may qualify for a return or exchange under that policy.

Free the Sheep does not currently operate a voluntary international return or exchange program.

International orders are not eligible for routine preference-based returns or exchanges. Free the Sheep will review damaged, defective, materially misrepresented, incorrect, incomplete, missing, or exceptional international orders and provide a reasonable resolution based on the circumstances, product availability, destination, and applicable law.

An international resolution may include:

• A replacement;
• A replacement part;
• A partial refund;
• A full refund;
• Store credit;
• A discount or another accommodation; or
• Another reasonable solution.

Because Free the Sheep does not currently operate an international return facility, an international resolution may be provided without requiring the customer to physically return the product.

Pre-order products will be identified on the applicable product page and will include an estimated shipping date or estimated shipping window.

All pre-order dates are estimates based on the production, transportation, inventory, and fulfillment information reasonably available to Free the Sheep at the time.

Estimated pre-order dates:

• Are not guaranteed shipment dates;
• Are not guaranteed delivery dates; and
• Are subject to change.

Customers may cancel an unfulfilled pre-order for a full refund to the original payment method at any time before fulfillment.

Orders containing both in-stock and pre-order products will normally ship together when every product becomes available.

Free the Sheep may approve or initiate a separate shipment in appropriate circumstances.

A customer-requested partial shipment may require an additional disclosed shipping charge.

If a pre-order estimate changes materially, Free the Sheep may provide an updated estimate, and the customer may either continue waiting or cancel the affected unfulfilled pre-order for a full refund before fulfillment.

Free the Sheep will also provide any additional delay notice, consent process, cancellation option, or refund required by applicable law.

Nothing in these Terms limits mandatory rights regarding:

• Damaged products;
• Defective products;
• Misrepresented products;
• Incorrect products;
• Delayed products;
• Missing products; or
• Undelivered merchandise.


SECTION 6 – BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse, limit, or cancel an order where reasonably necessary.

Restrictions may include orders placed using:

• The same customer account;
• The same payment method;
• The same billing address;
• The same shipping address; or
• Information indicating resale, fraud, or abuse.

If we change or cancel an order, we may attempt to notify the customer using the contact information provided with the order.

Customers agree to provide current, complete, and accurate purchase and account information.

Customers agree to update information when necessary so that we can:

• Complete transactions;
• Provide order updates;
• Process refunds;
• Deliver products; and
• Communicate about the order.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools that we do not control.

Third-party tools may be provided “as is” and “as available.”

Use of an optional third-party tool is at the user’s discretion and may also be governed by the provider’s own terms and policies.

We may offer new services, features, tools, or resources in the future.

Those additions will also be subject to these Terms.

The Service may include content, products, services, or links provided by third parties.

Third-party links may direct users to websites or platforms that are not controlled by Free the Sheep.

We are not responsible for:

• Reviewing all third-party content;
• The accuracy of third-party information;
• Third-party privacy practices;
• Third-party security;
• Third-party products; or
• Third-party services.

Customers should review a third party’s terms and policies before completing a transaction.

Questions about third-party products or services should be directed to the applicable third party.


SECTION 9 – USER COMMENTS, FEEDBACK, AND SUBMISSIONS

If you submit ideas, feedback, reviews, proposals, plans, photographs, videos, or other materials, you agree that, to the extent permitted by law, we may use the submission for legitimate business purposes.

We are not obligated to:

• Keep unsolicited submissions confidential;
• Pay compensation for unsolicited submissions; or
• Respond to every submission.

We may monitor, edit, restrict, or remove content that we reasonably determine is:

• Illegal;
• Threatening;
• Abusive;
• Defamatory;
• Obscene;
• Fraudulent;
• Infringing;
• Misleading;
• Spam; or
• Otherwise in violation of these Terms.

You agree that your submission will not violate another party’s:

• Copyright;
• Trademark;
• Privacy rights;
• Publicity rights;
• Contract rights; or
• Other legal rights.

You may not use a false identity or misleading email address to misrepresent the origin of a submission.

You remain responsible for the accuracy and legality of content you submit.

The submission and processing of personal information through the Service is governed by our Privacy Policy.


MOBILE MESSAGE TERMS

The Free the Sheep mobile message service is operated by Free the Sheep LLC.

By consenting to receive SMS or text messages from Free the Sheep, you agree to receive recurring messages at the mobile number provided.

Messages may be sent using automated technology.

Service-related messages may include:

• Order updates;
• Account alerts;
• Customer-support communications; and
• Other transactional information.

Promotional messages may include:

• Promotions;
• Product launches;
• Specials;
• Cart reminders; and
• Other marketing offers.

Consent to promotional messaging is not a condition of purchasing from Free the Sheep.

Message frequency varies.

Message and data rates may apply.

You are responsible for charges imposed by your wireless provider.

After opting out, you may receive a one-time confirmation message.

Wireless carriers are not responsible for delayed or undelivered messages.

You agree to provide a valid mobile number and to update your subscription if your number changes.

To the extent permitted by law, we are not responsible for failed, delayed, or misdirected message delivery caused by a carrier, device, network, or incorrect customer information.

Our use of personal information in connection with mobile messaging is governed by our Privacy Policy.


SECTION 11 – ERRORS, INACCURACIES, AND OMISSIONS

Information on the Service may occasionally contain a typographical error, inaccuracy, or omission relating to:

• Product descriptions;
• Product availability;
• Pricing;
• Promotions;
• Shipping charges;
• Estimated shipping dates;
• Transit estimates;
• Inventory status; or
• Other information.

We reserve the right to correct an error, update information, or cancel an affected order where reasonably necessary.

If we cancel an order or an unshipped product because of:

• An error;
• Unavailability;
• A pricing issue; or
• An inability to fulfill the product;

we will issue the applicable refund to the original payment method.

If correcting an error would materially affect an existing order, we may contact the customer to explain the change and provide available options.

Nothing in this section limits any notice, consent, cancellation, or refund obligation imposed by applicable law.


SECTION 12 – PROHIBITED USES

You may not use the Service:

• For an unlawful purpose;
• To encourage another person to participate in an unlawful act;
• To violate an applicable law or regulation;
• To infringe intellectual-property rights;
• To harass, abuse, threaten, defame, or intimidate another person;
• To unlawfully discriminate;

• To collect another person’s personal information unlawfully;
• To spam, phish, scrape, crawl, or interfere with the Service;
• For an obscene or unlawful purpose; or
• To circumvent security features.

We may terminate or restrict access for violations of this section.


SECTION 13 – DISCLAIMERS AND LIMITATION OF LIABILITY

We do not guarantee that the Service will always be:

• Uninterrupted;
• Timely;
• Secure; or
• Error-free.

The Service and products are provided subject to:

• Applicable product descriptions;

• Express warranties, if any; and
• Mandatory legal rights.

To the maximum extent permitted by law, Free the Sheep and its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors will not be liable for indirect, incidental, punitive, special, or consequential damages arising from use of the Service or products.

Where a jurisdiction does not permit a particular exclusion or limitation, liability will be limited only to the maximum extent permitted in that jurisdiction.

Nothing in these Terms excludes liability or a remedy that cannot legally be excluded.


PACKAGE PROTECTION

Package Protection is an optional add-on offered directly by Free the Sheep for eligible orders affected by loss, theft, or damage during transit.

It is not represented as a third-party insurance policy.

Package Protection is governed by our Return and Refund Policy.

We may reasonably request documentation and investigate a claim before approving it.

Nothing in the Package Protection terms limits a remedy or obligation that cannot legally be waived.


SECTION 14 – INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Free the Sheep and its affiliates, officers, directors, employees, agents, contractors, service providers, suppliers, and licensors from third-party claims arising from:

• Your material breach of these Terms;
• Your unlawful use of the Service;
• Your violation of another party’s rights; or
• Content submitted by you.

This section does not require indemnification where prohibited by applicable law.


SECTION 15 – SEVERABILITY

If a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary.

The remaining provisions will continue in effect.


SECTION 16 – TERMINATION

Obligations and liabilities incurred before termination survive termination where appropriate.

You may stop using the Services at any time.

We may suspend or terminate access when we reasonably believe that a user has materially violated these Terms, applicable law, or the rights of another person.

Termination does not eliminate amounts lawfully owed or obligations arising before termination.


SECTION 17 – ENTIRE AGREEMENT

These Terms and the policies incorporated by reference constitute the agreement governing use of the Service.

They supersede prior versions relating to the same subject matter.

A failure to enforce a provision does not waive that provision.


SECTION 18 – GOVERNING LAW

These Terms and any separate agreement through which we provide the Service will be governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles.

Mandatory consumer-protection rights available under the laws of a customer’s jurisdiction remain unaffected to the extent those rights cannot legally be waived.


SECTION 19 – CHANGES TO THESE TERMS

We may update or replace portions of these Terms by posting an updated version to the website.

The Last Updated date will reflect the effective date of the revised version.

Continued use of the Service after an update constitutes acceptance of the revised Terms to the extent permitted by law.
